1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Tap Tidings ("we," "us," or "our") governing your use of the Tap Tidings application, including our web app, iOS app, Android app, and any related services (collectively, the "Service").

By creating an account or using the Service, you confirm that you are at least 13 years old (or 16 in the EU), that you have the legal capacity to enter into these Terms, and that you agree to be bound by them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

Tap Tidings is a personal relationship-care application that enables users to:

Store and manage a personal contact vault with relationship details and important dates
Receive reminders for upcoming occasions (birthdays, anniversaries, custom events)
Generate personalized digital tidings using AI-assisted message and image creation
Send tidings via email to recipients
Track interaction history with contacts
Receive gentle warm nudges to maintain meaningful connections

The Service is intended for personal, non-commercial use to help individuals nurture their personal relationships.

3. User Accounts

3.1 Registration

You must create an account to use most features of Tap Tidings. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at hello@taptidings.com if you suspect unauthorized access.

3.3 Account Deletion

You may delete your account at any time. Upon deletion, your account, login credentials, and all associated personal data — including contacts, tidings, reminders, and interaction history — are permanently removed immediately in accordance with our Privacy Policy. Unused subscription credits or prepaid periods are non-refundable except where required by law.

4. Contact Data & Third-Party Information

Tap Tidings allows you to store personal information about third parties (your contacts). By adding contact information, you represent and warrant that:

You have a legitimate personal reason for storing this information (e.g., you are personal friends, family, or colleagues)
You are using this information solely for personal, non-commercial relationship management
You will not use Tap Tidings to store data about individuals for commercial prospecting, marketing, or any purpose that would require their explicit consent under applicable privacy laws
You will not add contact information for individuals who have requested you stop contacting them

Tap Tidings is a personal-use tool. It is not a CRM, marketing platform, or commercial contact management system.

5. AI-Assisted Content

5.1 Nature of AI Content

Tap Tidings uses artificial intelligence to assist in generating tiding messages and visual designs. All AI-assisted content is provided as a starting suggestion. You are responsible for reviewing all AI-assisted content before sending.

5.2 Accuracy and Appropriateness

AI-assisted content may occasionally be inaccurate, inappropriate, or not suitable for your specific situation. We do not guarantee that AI-assisted messages or images will be accurate, complete, or appropriate for all occasions and recipients.

5.3 Your Responsibility

You are solely responsible for the content of tidings you send. You must review and, where necessary, edit AI-assisted content before sending. We are not liable for any harm caused by AI-assisted content that you choose to send without reviewing.

5.4 Content Restrictions

You may not use AI generation features to create content that is: defamatory, harassing, threatening, obscene, or illegal. We may remove content or suspend accounts that violate these restrictions.

6. Subscriptions and Billing

6.1 Free Plan

Tap Tidings offers a free plan with limited AI message generation and card design credits per calendar month. Free plan limits are subject to change with notice.

6.2 Paid Plans

Paid subscription plans (Premium Monthly and Premium Annual) provide increased usage limits. Subscription pricing is displayed at the time of purchase.

Premium Monthly: Billed monthly. Cancel anytime; access continues until end of the current billing period.
Premium Annual: Billed annually at a discounted rate. Cancel anytime; access continues until end of the annual period.

6.3 Pay-Per-Tiding

Single-use tiding credits may be purchased separately. These credits do not expire and are non-refundable once used.

6.4 Billing

Subscriptions purchased through the web are billed via Stripe. Subscriptions purchased through the Apple App Store or Google Play are subject to those platforms' billing terms and managed through your account on those platforms. We do not handle billing disputes for in-app purchases — contact Apple or Google directly.

6.5 Refunds

Web subscriptions may be eligible for a prorated refund within 7 days of the first purchase if requested via email. Renewal charges are non-refundable. In-app purchases follow Apple and Google refund policies.

6.6 Auto-Renewal

Subscriptions auto-renew at the end of each period unless canceled. You will receive a reminder before annual renewals.

6.7 Usage Limits

AI message and image generation are subject to monthly usage limits depending on your plan. Limits reset at the start of each calendar month. Unused credits do not roll over.

7. Email Delivery

When you send a tiding via email, you authorize Tap Tidings to send a single email to the recipient email address you specify on your behalf. By using this feature, you confirm that:

You have a genuine personal relationship with the recipient
You have not been asked to stop contacting the recipient
The email address you provide belongs to the intended recipient

We reserve the right to rate-limit or disable tiding email sending for accounts showing patterns consistent with spam or abuse.

8. Reminders and Notifications

Reminder emails are sent based on dates stored in your contact vault and your notification preferences. You can disable all reminders at any time in Settings. Reminder delivery is not guaranteed — it depends on email deliverability and your device's notification settings for push notifications.

9. Acceptable Use

You agree not to use Tap Tidings to:

Violate any applicable law or regulation
Harass, stalk, or harm any individual
Send unsolicited communications (spam) to anyone
Impersonate another person or entity
Attempt to gain unauthorized access to any system or account
Interfere with or disrupt the Service or its infrastructure
Use the Service for commercial data collection or prospecting
Reverse engineer, copy, or distribute any part of the Service

We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.

10. Intellectual Property

10.1 Our Property

The Tap Tidings application, including its design, code, brand, and non-user-generated content, is owned by us and protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our written permission.

10.2 Your Content

You retain ownership of the personal information you enter (contact details, notes, edited tiding messages). By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you.

10.3 AI-Assisted Content

AI-assisted messages and images are provided for your personal use. Ownership of AI-generated output may be subject to the policies of our AI providers. We make no warranties regarding your exclusive ownership of AI-generated content.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT: (A) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) AI-ASSISTED CONTENT WILL BE ACCURATE OR APPROPRIATE; (C) REMINDERS WILL BE DELIVERED ON TIME; OR (D) EMAILS WILL BE DELIVERED TO RECIPIENTS' INBOXES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TAP TIDINGS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, MISSED OCCASIONS, OR RELATIONSHIP HARM, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $10 USD IF YOU HAVE NOT MADE ANY PAYMENTS.

13. Indemnification

You agree to defend, indemnify, and hold harmless Tap Tidings and its officers, employees, and agents from and against any claims, liabilities, damages, and expenses (including attorney's fees) arising from your use of the Service, your content, or your violation of these Terms.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or if required by law. You may terminate your account at any time. Upon termination, your right to use the Service ends immediately. Sections 10, 11, 12, and 13 survive termination.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in California. If you are a consumer in the EU, you retain the benefit of mandatory consumer protection laws in your country of residence.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree to updated Terms, you must stop using the Service and delete your account.

17. Apple App Store Additional Terms

If you downloaded Tap Tidings from the Apple App Store, the following additional terms apply:

These Terms are between you and Tap Tidings only — not Apple. Apple is not responsible for the app or its content.
Apple has no obligation to provide maintenance or support for the app.
In the event of any failure to conform to applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no further warranty obligation.
Apple is not responsible for addressing any claims by you or any third party relating to the app.
If a third party claims the app infringes their intellectual property, Apple is not responsible for investigating or defending such claims.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
